Notice issued to Eight respondents in Tasman Spirit Case

KARACHI: Justice Zawwar Hussain Jaffery of High Court of Sindh (SHC) on Tuesday issued notices to Salvor Master, Nicholas Papas, Captain Krystinoe Dimitryios, Master of Tasman Spirit and others for Feb-23.

The bench was hearing a criminal miscellaneous application filed by Captain Iftikhar Ahmed, Deputy Conservator, KPT.

Plea


The applicant challenged order of District and Sessions Judge, West in a revision application filed by KPT impugning order of Judicial Magistrate Mumtaz Solangi who treated interim charge sheet as final charge sheet.

The DJ held that judicial officers have powers to treat interim charge sheet as final and that Investigation officer or agency can submit a final chalan after due investigation if are in possession of additional/more/ new evidence.

Mehmood Alam Rizvi advocate appearing for the applicant said that concerned court failed in appreciating the complex nature of evidence in the instant case and also ignored the fact that Investigating Officer has to collect evidence from over seas.

The bench after hearing the counsel issued notices to all the respondents for Feb 23.

The Episode
